Self defense is a very complicated legal situation most of the time. You really can't just gun someone down unless they have a lethal weapon as well. You must use proportional force. Now if the fat patriot was literally on top of the security guard punching his face in then yes deadly force would have been legal.

Generic self defense info:

act reasonably retreat if possible without taking any physical action, and use only the amount of force reasonably necessary to fend off the attacker.

Colorado law is a bit different but it still says you should only use deadly force to defend against deadly force. Colorado however does not have a duty to retreat law. The courts will have to figure it out. I don't think it will work out well for the shooter but I am not a lawyer.

This guy is and has a lot more info than I care to post.

Most states don't have a duty to retreat law (which is good, those things are stupid). But yes you're only allowed to use deadly force when you believe the person poses a significant threat of serious bodily injury or death to yourself or others. So definitely not in this case.

Otherwise every time some jerk pushed someone they could fast draw a pistol and kill them. Which is pretty much what happened here.
