Easiest answer: Find out if the local police department lethal force guidelines allow an officer to use deadly force if facing an attack or assaulted with a chemical weapon.
What a sworn law enforcement officer can do and what a citizen can do are different, but overlapping. If the officer has to back off, citizens probably do to.
For this case, check to see if state or local law, including case law, imposes different rules on security guards.
My worthless opinion: It was murder. There is a lot of narrative about chemical weapons and tasers being 'non-lethal' or 'less lethal' and are used to avoid permanent damage, as compared to a gun or night stick.

Are we accounting for the time for the sound to travel? I think the pepper spray happens about 1 second before the shot. He goaded him into shooting him because he had the gun ready, just needed a reason to use it. That's my take.

Patriot had pepper spray in hand
Patriot walked away from first scene
Shooter attempted to grab Pepper Spray from Patriot
Patriot swiped at shooters face while retreating
Shooter began to unholster weapon
Patriot raised mace as shooter was drawing
Shooter racked weapon and began to aim
Patriot fired mace for less than 1 second
Shooter fired upon patriot, shooting him dead
