First, it will be 9NEWS (the local station), not NBC.

But, it will depend on whether Pinkerton presented him as a properly-licensed security guard. If they did, then 9NEWS is at least partially in the clear, if the contract was worded properly.

Of course, a jury may decide to assign some fault to 9NEWS, especially if the reporter is viewed as contributing to the confrontation.

Spez: corrected station name: it's 9NEWS, not 9NBC. The station is KUSA.

The news station released a statement saying they hired a guard through Pinkerton. I'm pretty sure that was bullshit. Maybe their regular security guards at the station are through Pinkerton.

Hell, I'll even be generous -- maybe this guy is a Pinkerton guard employee who normally sits in his uniform guarding the station in the middle of the night, so that meth-heads don't smash a window and steal things out of the lobby. Off-duty, out of uniform, on his own time, that doesn't mean he gets to go around carrying a gun and "protecting" the reporter, any more than a Boeing janitor gets to take a 787 out for a spin at night.

First, I've corrected it: it's not 9NBC, it's 9NEWS, or KUSA.

While the major networks do own some local stations, most affiliates are separately owned and simply license the major network's content.

KUSA is an NBC affiliate, owned by Tegna.

He wouldn't even be employed by Pinkerton if he wasn't licensed. I'm not sure where the Pinkerton story came from but if he wasn't licensed then that story is wrong. I worked security for nine years and these big companies don't risk the liability in hiring unlicensed guards.

Per Denver code, a security guard has to also submit a request to the Department to get permission to work in plain clothes, as well as to carry a weapon. If operating in plain clothes with a weapon, he is still required to have a clearly visible ID. Doloff failed on all fronts.
