That is what it looked like to us, but I am guessing the DA chose 2nd because it is a slam dunk, and a jury might let him walk on 1st degree murder without additional corroborating evidence that I am guessing prosecutors don't have.
I think 2nd degree is fair. In my researching Dolloff over the past week, he seems like someone who grew up in a conservative community, with many conservative values (small business owner, married, family farm), but was drawn to socialism, likely in High School. He was a total gun guy (made much of his income at gun shows), looking at the firearm he used (upgraded Glock 19 with an RMR red dot, suppressor sights, and a weapon's light). It really is a shame that he chose to path he did, because he could have easily been on the winning side.
I think he honestly went to the protest as a security guard, but hadn't trained (or been licensed) as one. Had he been licensed, he would have learned the nuances of when to draw and when to fire. His weapon's manipulation technique was impeccable. He drew, aimed and fired very quickly. His neighbors mentioned that they would often see him shooting at his farm shooting range.
What he was missing in his training was discernment for how to react to less than lethal threats. Surely Keltner posed some sort of a threat, albeit minor, to Dolloff. However, in Dolloff's mind, he likely had only trained for seeing a threat, and reacting using the tool at hand (firearm) to stop the threat. He made a terrible decision that day, and his life is ruined because of it, not to mention Keltner's.
WTF.. This is premeditated. He went there with someone. Agitated, so as to draw into a scenario for him to shoot.
No justice.

Give the producer 1st degree charges. Prob easier to show the shooter himself 'fucked up' but there was certainly pre-meditation in the set-up.
And what about BGM - T-Shirt guy? Round that faggot up.
If he went there with someone to agitate for him, he was pre mediating the very scenario he was involved in. First degree, without a doubt.
