His executive order has been in effect for the past year at this point (when taking into account the 45 day time periods dictated in the EO starting from before the 2018 Midterm Election) He can execute executive action at anytime and declare a national emergency over this fraud.

I believe if things get to the point of no return - that is what will happen. Although, of course, you can then expect the media (for however long they exist after he executes the order) to be screeching that he is a dictator and a fascist and all the other same exact bullshit they've been screeching for the last 4 years.
