Cruz says what we all know: the fraud wasn't proven in court. Unfortunately we never got that chance. I don't think that makes him a PINO. And no one is going to want to hear this, but while I don't for a second think that Trump "incited a riot," I do think he was irresponsible. He called for patriots to descend on DC; "it will be wild." Then it was just the same old thing: no new proof of fraud that both he and Rudy had talked about; nothing new in what amounted to a rally speech; a crowd of one million + hyped up people all basically depending on Pence. And then Pence punted. I'm not sure exactly what Trump expected or wanted to happen that day, but when you've got that many people pumped up and excited and then it all goes to shit in the space of five minutes, it's little surprise that people became angry and unruly. Again, I don't hold Trump responsible for that; people make their own decisions and are responsible for their own behavior. But it was a mess waiting to happen and I fail to see how Trump couldn't have known that, unless he severely underestimated how upset people were, and are.So I don't find issue with what Cruz is saying.
