I don't think the first step is to establish whether or not he's a public figure. It's one of them, but elections are a matter of public interest and if he's a high level official and he really was involved in the corruption alleged, then he can't hide behind being a private citizen.

I didn't see in the article where the guy denies any of the allegations that Giuliani and everyone else were making.
Not once.
He's not denying that that was him and the truth, and the elections being a very serious public interest issue, make it so he will have to either deny or admit it was him.
