What are all these activists group doing if not suing government? All the ACLU lawsuits? All the immigration bullshit. We literally have people rolling over the border and appealing their expulsion. Or literally suing the US for a green card.

It's not like 42 USC section 1983 exists and is the most used piece of legislation to bring suit for tort against the Feds.

We aren't talking about slipping and falling in the post office which would be FTCA. We are talking emergency grants from the FDA for experimental drug deployment.

Read up a bit on Westfell v Erwin and the 1988 FTCA amendements. The entire purpose of the FTCA is to allow tort against government but not actually have any individual liable. The FDA has special protection unless it's found negligent.
