First degree intentional homicide will not stick. I wish and hope the kid walks free for what I see as a 100% justifiable case of self defense.
However, that being said, where I see this going is this kid being charged and could even be found guilty of Third Degree Murder. Apparently he was 17, and Wisconsin requires an individual to be 18 to open carry or even be in possessionof a long gun. So him being 17 and opening carrying and possessing an AR is the felony, and during the commission of that felony, 2 people wound up dead and one has been disarmed. It sucks, I do not agree with what will happen, but be prepared for that outcome.
Sometimes the right to certain self-defense laws like stand your ground are waived if you're illegally possessing a firearm. However this kid was being chased and did everything in his power to flee before he was overcome by his attackers. The law will usually permit the use of self-defense when all options have been exhausted, like in this kids case. What I see the most likely outcome for this kid, is he will not be convicted of murder, but he will be found guilty of numerous weapons violations.
