There is a point of insurrection where the president can take command of the national guard + military to quell an insurrection but so far the line of insurrection is being danced on and hasn’t been crossed. Up to a certain point, this kind of citizens uprising is exactly what the founding of our nation with our bill of rights aimed to protect from the government. The problem here is that bad people are behind it and they are working with foreign actors to instigate it. This places those leading the insurrection squarely in the scope of treason and sedition laws.

The radicals on the streets are not within the same scope as those working with foreign nations. Compartmentalization and all. This means that other than the domestic laws broken and some are committing federal violation, the local municipality and state governments have the choice of enforcement of their respective laws. As the law enforcement is under the authority of mayors and governors, they can selectively enforce the law as they see most appropriate for the governance of their respective jurisdictions.

As the riots spread and those doing the rioting travels state lines, it begins to fall under federal jurisdictions and we are seeing the feds making those arrests.

If the foreign actors are revealed publicly and the riots continue then the rioters are knowingly acting on behalf of a foreign power and begin crossing into the scope of treason.

It is when lawful orders are refused from the federal government that are based in federal laws passed by Congress that an insurrection can be declared. So far there is not an insurrection by law while optically it appears to be.

This means that it is only the acts of treason that can be addressed. Antifas mostly flat organizational structure protects them from many of our laws. Them having a command and control structure would make it a conspiracy to overthrow the federal government with foreign actors behind it which would make it an act of war allowing the President to engage over the wishes of governors.

To date the C&C structure of Antifa has not been made public but the DoJ has threatened to expose it but is likely withholding it to build a rico case to take them all out at once by letting them all commit enough criminal acts that no one is safe from prosecution. America can handle a bit of their chaos for a while. The optics are destroying the left and they are losing popular support across the board. The longer we can endure this without ripping one another apart as they put on their pageantry, the more complete the rico case against the bad actors will be.
