It's a multi-step process:

1. Pence and majority of cabinet (or this "commission", if it is law) agree Trump is unfit to serve.
2. Pence becomes Prez.
3. Unless he is truly incapacitated, Trump declares he is fit to serve.
4. Within 4 days, Pence and cabinet/commission agree AGAIN.
5. Within 48 hours, Congress assembles (if not already in session)
6. Congress has 21 days to decide whether Trump is unfit to serve. This requires a 2/3rd vote of both the House and the Senate.
