Trump could not use the Insurrection Act by pinning it on the House and Senate for the following reasons: [10 U.S. Code § 253 - Interference with State and Federal law] He could not convince them that they were interfering with State and Federal Law [10 U.S. Code § 254 - Proclamation to disperse] He was generally unable to tell the swamp to stop. Everything they did was by the book (courts threw complaints out and kept everything as de facto ok until proven otherwise)

In comes the January 6th Rally: Trump supposed to appear at 11AM Senate started counting votes at 1PM Trump is late by "accident" Tells them all to head over for the Jericho March at the new time of during the voting counts, Cops (US Capitol Police only) oddly enough allow them inside with hardly any fight (https://twitter.com/moonddng/status/1346924307692318723?s=21), Trumpers floods Capitol Hill, Senate interrupted and adjourned temporarily [10 U.S. Code § 253 complete] Trump tells them all to stop and to go home, [10 U.S. Code § 254 complete] Bam.
