2nd degree manslaughter would require (1) by the person's culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another

3rd degree manslaughter doesn't exist that I can find.
Asphyxiation is NOT strangulation. A lot of people here have been confused on this point. It means death by low oxygen. 8 AM Thursday morning the blood test taken 9:30 the night GF died shows 98% oxygen saturation; maximum oxygen! NOT low oxygen.
