It is illegal to get the gun. Yes. But its a check. Its not illigal to do a background check and fail it. You wont get arrested. You just get denied and get your money back. Thats the purpose of the check.

Background checks. He is talking about failing background checks and getting them when they fail the check. Its a check. You cant arrest someone for failing a check. That isnt a crime. The check is a process. You fail....you get your money back...you get no gun. Pretty simple. It stopped a crime from happening. But it isnt a crime to fail the check. Thats what it is there for. Its to check and stop people from committing the crime. That is the preventative measure.

In order for a crime to be committed, a felon has to obtain a gun or make an act to illegally obtain the gun...they have to pass off money, bribe, fake who they are, or steal. This is the ACT of trying to get the gun. Failing a background check isnt a crime. At least...not right now.
