Whatever it paints itself as, this site is currently very much under the protection of 230. Without it, the mods/owners could be sued by anyone who takes issue with something posted here. The fact that moderation of people who go off-topic doesn't remove that protection, is also something that 230 specifically ensures. That's when it's working as intended.

The second part of Trump's EO from a few months back, is the best take I've seen on it; it's the fact that rules are changed on a moment's notice, specifically to catch people out and ruin their business before they can find an alternative platform, that has to be separated away from the protections of 230.

It doesn't need to be proved that fraud took place. It only needs to be proved that the rules weren't followed. At that point, fraud is the default assumption, that in turn would need to be disproved (which is impossible).
