There are elements and definition to every crime, you learn that in L1. Definitions and precedent matter. Just because you hear something on Tucker doesn’t make it true. I wish it was that easy but it isn’t. People always want to spout out legal stuff they hear from experts, but they are only listening to what they want to hear the expert say, even when they use exclusionary language. Problem is that most people put the constitution up as some protective entity, and it obviously isn’t. I am sure we’re on the same team here, but no one will be charged with treason unless we’re at war.

Time of war. Treason by aiding the enemy can't be committed during peacetime; there must be an actual enemy for the traitor to aid. The requisite enemy designation typically requires a formal declaration of war.
