The largest issue by far, is that most Americans nowadays will go along with whatever they rule even if it's unconstitutional as to not "inconvenience my day." Unfortunately, many voices outside of this community are pushovers and will do as they're told. They could order something unconstitutional, get struck down by SCOTUS, and people would probably still follow the order out of fear.
