Honestly my understanding of the judicial branch is that they are a coequal branch of government. As far as I know, they could just refuse more members. Nothing on the constitution other than "there will be a supreme court". I have no idea if they would, but it's an interesting idea to explore.

See what you see as "jacked up on ego and gunpowder" I see as "way too scared to be in that situation." The Officer giving orders wasn't "power tripping", he was terrified, and frankly it's just as dangerous.
I have a lot of mixed feelings about this case considering that they took a female into custody before the dude came out into the hallway. It seems way more like poor training and lack of experience in that situation than malicious intent. I think most bad shoots I've seen have been this. Cop goes in and gets spooked and bad things happen. It's a great indictment of police training for sure. Police brutality, maybe not.
EDIT: To those disagreeing, that's fine, but don't think I'm trying to justify anything here. I just believe the cop in question was a moron and that turned him into a murderer, rather than this cop was a psycho who finally found his opportunity. If you're gonna be mad, at least be mad at what I'm actually saying.

If they'd have stuck with Manslaughter, they might have had a case. (not saying it was manslaughter, just that you could make that argument) But there is zero chance of getting a murder charge. Even if he were culpable, it's the wrong charge.
