I feel this has been challenged in court before and lost. There is a lot of sway in understanding of it. The 14th Amendment gives constitutional protection of the basic rights of citizenship: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the States wherein they reside." Because this is very vague around the parents it looks at the kid. Our law says as long as they are here they are granted US Citizenship no matter their parents.
