He's a hardworking kid, kept down by the oppressive regime of Governor Pritzker. He travelled a standard commute north to work as a lifeguard, and apparently he spent the night before at his friend's house in Kenosha so that he could be closer to work.
The rights of speech and assembly under the first amendment are not absolute; rather, they are subject to reasonable time, place, and manner restrictions.
For example:
Time: assembling after curfew in a given area is not a lawful assembly, and thus not a protest protected by 1A.
Place: the government may restrict where you may protest, so long as the restriction matches the forum. Non-public forums may be totally restricted (a closed courthouse, a police station, the halls of Congress, a military base, etc.).
Manner: while there are protected physical acts of speech (putting a fist in the air, carrying signs) throwing something that can cause harm, harassing people, and other violent acts are not protected speech.
When an assembly or "protest" violates these restrictions (which are somewhat particular to each jurisdiction), it may be declared an unlawful assembly. Then, it may be dispersed and anyone who remains is subject to arrest.
