GF was handcuffed when Chauvin arrived on scene. We've been told by witnesses for the prosecution that if a cop takes someone into custody, they are then responsible for that perp's care. What was Chauvin's role? Will defense raise this issue? By this standard the 2 Officers who handcuffed GF are responsible rather than Chauvin. Or perhaps additionally, I'm not sure how the legality of it works.
I'm not arguing anything. We've heard experts on both relevant medical fields and Police use of force claim that GF's position alone COULD HAVE killed him, but that hypothetical isn't that important because weight, force, or further obstruction of breathing would add to the likelihood of death. I don't see any way around that.
Chauvin certainly did all of the above. Had he rolled GF onto his side or sat him up after he passed out, Chauvin would clearly be in a better position now. Some witnesses made it seem like maybe that'd be enough. Others said Chauvin would have needed to make that shift in tactics as soon as GF was "subdued." Maybe defense can raise doubt about that for a significant amount of the 9:29 GF was restrained in the prone position that he couldve still posed a risk. You've still got the final 4:44 to account for, and so far there's been no justification for that. Plus simple chest compressions might have saved him at that time.
Only the final expert for the prosecution claimed that GF should never have been put in the prone position and that much was unjustified. I think he hurt the State's case.
Floyd never asked to be put in the prone position with his hands behind his back and 3 Officers on top of him for 5 minutes until he died, and then continuing to hold him there until EMTs had no chance to help. That's not an argument that can be made.
