I'm not comfortable with the government arresting people based on their interpretation of what constitutes a fraud as opposed to a meme. Great way to open us up to unequal application of the law. If someone is tricked when they saw this their civic ignorance is to blame as much as the text on the meme.
Our system is one where our justice department and law enforcement agencies pick their battles using capricious methods, so codifying infringements to the 1st amendment will turn into a weapon used on the whim of district attornies and the like. There is no bigger slap in the face than when a law or precedent is made that is impossible to enforce equally, or is in effect made to curtail some but not all offenders.
