Pretrial discovery covers witnesses, I don't see these witnesses mentioned in previous docs. https://www.courtlistener.com/docket/62601657/united-states-v-rhodes-iii/ This is shady conduct by the prosecution that would be, in a fair court, either thrown out or delay the trial to allow the defense to interview the witnesses as part of the discovery process.

Before the trial, you have to reveal the evidence you're going to use to the other side. This is called "Discovery". https://www.americanbar.org/groups/public_education/resources/law_related_education_network/how_courts_work/discovery/

If you're accused of stealing a candybar, and they're going to use the surveillance video of you stealing the candybar, you have a right to watch that video prior to the hearing. What if the video has a date/time stamp from when you were at work? You'd need time to get evidence (copies of timecards, whatever), to prove you were at work then. Or what if it was edited footage? You'd need time to find an expert who can examine and speak to the editing at your trial.

But a corrupt prosecutor could hide the existence of surveillance video from you until trial, and spring it on you. Then you wouldn't have the evidence proving you were at work then, or the footage was fake, and you would go to jail. If you have a good defense attorney, and a fair judge, the surveillance video will be thrown out and disallowed from the testimony, because you weren't allowed a fair defense.

So in this case, they have testimony from their spies, they've had it for a year, and now a week before trial they want to include the testimony in their court case. They've prevented the defense from spending any time preparing counters for the evidence or investigating the details surrounding said evidence.

That's not the problem, the problem is they didn't admit to it during discovery.

Essentially, the defense has been preparing to counter certain evidence and claims for the last two years, and now at the 11th hour, "oh shit we forgot to tell you as legally required that we actually have this evidence" with a bonus of "also we just arrested your two witnesses so they can't testify either"

That part is fine. The part that's not fine is where they were going to rely on this evidence and didn't admit to it during discovery.

And they just arrested two of the j6ers witnesses, so he can't use them in his defense. It's all massively illegal and partial, but they don't care because it's DC and they're all party members.
