Totally agree, but the depressing part is that they won’t destroy themselves. Many will abandon their shytt hole cities/states and infect new cities/states with their ideologies/religion. Nothing is closer to Syrian/Somali refugees than American Leftists. Americans just have slightly more disposable income and their backward politics is their martyr-worthy religion. It’s sad but true.

I don’t that this particular issue has been heard by SCOTUS and this isn’t my area of practice, but like a search during a Terry Stop (based on reasonable suspicion; lower standard than probable cause, which these officers had), this “hold” may very well be considered Constitutional provided it is reasonably necessary to ensure the safety of the arresting officers and passers-by. However, imo, maintaining that hold after the officers’ have secured the scene and to such an extent that it results in the suspect’s death (thereby depriving him of all current and future Constitutional rights) should likely be seen as an unconstitutional use of force, assuming the court ever hears the case.
In all likelihood, the Court would address this question circuitously through dictum in a case relating to state laws outlawing choke holds or repealing certain officer-related immunity provisions. Perhaps someone who practices Constitutional Law can further educate both of us, but in the meantime I’ll be arguing for the protection/expansion of our Constitutional rights, even when it’s not convenient to do so.
No it doesn’t, you’re right, but I doubt you’ve studied enough Constitutional law to make anything other than a strawman argument, so it’s whatever. Although this type of restraint is almost certainly Constitutional, holding it longer than is reasonably necessary for the safety of officers or nearby individuals almost certainly is not. And it shouldn’t take the SCOTUS to explain that to an officer of the executive branch. I’m out on that treatment of our citizens.
