Obviously each situation is different, but in this situation...

  • Draft and introduce new legislation.
  • Issue subpoenas, hold hearings, and be willing to hold them in contempt of congress.
  • Coordinate with the appropriate regulatory agency to introduce new regulations and/or break up their monopolistic power.

No, "taking the path of least resistance" is EXACTLY the problem that is sinking the GOP right now. Squishy republicans constantly throw their hands up whenever anything gets difficult, but instead they need to fight! The left understands this is a war, now the right needs to start getting in the fight.
