Charles Evan Hughes, Chief Justice of SCOTUS during the FDR admin, was threatened with court packing and allowed the FDR admin to substantially expand the power of the executive branch. The New Deal should have been stopped in its tracks by SCOTUS and the imbalance of federal government power we now see. So, two key points: the New Deal expanded the executive branch powers beyond constitutional limits and this was primarily due to SCOTUS not standing their ground and exercising their constitutional duties.

Depends on who you ask and what the "theory" was. Some people were blaming the actual fracking. But it wasn't the fracking itself it was the massive amount of water needed for fracking and produced from the formation that gets injected into a deeper disposal reservoir that caused the problem.
