In response to your other three posts: I don’t care about pot, but heroin, meth, and cocaine turn people into a husk of a human and are wildly addictive. I stand by my stance on those drugs. I’m conservative, not a full libertarian.
I’m a cop. No warrant takes any less than an hour and a half to get done at a minimum, and that was with swearing to it over the phone and emailing the template warrant that had to be written. Most cops aren’t super experienced with warrant writing, so a vehicle warrant will likely take about three hours. I’ll give you the benefit of the doubt and we’ll call it two hours.
Is it reasonable to keep someone detained with handcuffs behind their back for two hours while I don’t have an arrestable offense on them? I see mounting circumstances that give me probable cause to believe that there is evidence being used in the commission of a crime in that vehicle, but I’m unable to just snag it short of a search warrant, or a search warrant exception (which is what we’re talking about here). Courts have deemed that searching a vehicle that is capable of leaving with evidence in hand is reasonable and practical upon probable cause, which isn’t even a loose translation of the 4th, it’s a verbatim application of it.

I quoted the actual text for a reason here. The 4th is not understood by a lot of people. It protects you against an unreasonable search. Say a drug dog alerts on your vehicle in an open air sniff in the vicinity after you’ve been stopped. That dog has 2,000 hours of training and a 97% success rate as documented by it’s handler. Is it then unreasonable to search the vehicle?
It also states that warrants will be issued with probable cause. The 4th isn’t so much a guarantee your shit can’t be searched as much as it is a baseline minimum in which your shit can be searched. See the difference? That being said, we are one of the most protected peoples on the planet from searches.
This case in particular is dumb. Vehicles need to be searched sometimes without a warrant when there is probable cause to do so. Particularly since evidence in a car can be fleeting if the vehicle is capable of going mobile.
