I am still writing my goddamned senator and Rep demanding that they fix the goddamned voting in my state. They saw what will happen every single time if they do not make mail in voting illegal; make observation of the ballots transparent and open; signature matching and paper ballots only. Georgia currently has the House, Legislature, Governor and Lt. Governor, S.O.S. and they let this happen. If they don't fix it there will already be a lower voter turnout of Republicans plus all the cheating of the dems and Kemps and Raffenspergers. I am so frustrated! I've tried babysitters, mother-in-law, uncle, friend's mom (all in state); my liberal aunt in NC; aunt, friend and another friend from TX (to GA) with offers to pay for their flights. No one can watch my two kids (under 4 yrs.) on the 5-7th. And there's no one left whom I trust with my kids for 3 days. I left nothing on the table, especially when asking my NC aunt.

I'm sending my husband and father-in-law to DC without me. I will be there in spirit and will continue to write and call our corrupt Governor and Republican leadership in GA to stopthesteal.us

I have written and called my Georgia Senator, Representative, Governor and Secretary of State (daily) asking that they look into the election irregularities and call a Special Session to certify the correct electors or at least de-certify Biden. I received a statement from GA Senate Republican statement which is just passing the buck on THIS election:

They state "Even if we could secure the requisite numbers to convene, our laws provide no avenue for us to retroactively alter the results from November 3, 2020."

So I attempted to look up our election laws and guess what? Our great S.O.S. has made those files RESERVED so you have to request or pay or go and get hard copies and cannot just access online. http://rules.sos.state.ga.us/gac/183-1

I've been closely following the options and some think the Supreme Court will actually decide to rule whether the Constitution means something; others think they will not get involved because this is "political". Some think VP Pence will just do the right thing and ignore Biden electors, some think that's preposterous. The overwhelming thing I've heard from everyone is CALL, EMAIL, FAX your State Legislators and Governor and demand that they call for a Special Session to either de-certify the Biden electors or certify the Trump Electors. We must have a contested election in Georgia. I don't even know if our Senators will be able to vote on January 6th as the new Senators are sworn in on January 3rd and I doubt the vote will be counted by January 6th in order for them to contest.

I have called and emailed Loeffler and Perdue saying that they need to refuse the certification of the electors from contested states, especially Georgia. But are they even going to be able to vote in the January 6th session??? Let me know. I don't want to spend time on them if it's not even possible.

Dear Senator,

I request you exercise your Constitutional and statutory authority to object to the certification of any elector from any state that refuses to allow a meaningful audit of the November general election for electors to the Presidency, which must include: 1) a re-canvass of the vote that authorizes independent confirmation of a signature match using the same standards the same election officials use for nomination petitions, recall petitions, and initiative petitions; 2) publishing of the ballots for the world to review and observe, as states promised when they wrote large taxpayer checks to election machine companies like Dominion and others; and 3) audited review of the voter rolls to insure only qualified voters cast ballots for electors to the Presidency. If a state refuses to allow an honest audit of the vote, then I request you object to the certification of any electors from that state which has refused such an audit. At present, this includes the electors from Arizona, Georgia, Michigan, Nevada, Pennsylvania and Wisconsin.

There is reason for my concern. The state legislatures in the respective states chose a method for choosing electors to the Presidency that cabined who qualified to vote, constricted the manner in which a vote could be cast, and circumscribed how the vote could be counted. Many of the restrictions and requirements for each of those three were not followed by several of the states in question. President Carter warned in 2005 that absentee ballots posed the greatest risk of fraud. The New York Times agreed in 2012 that absentee ballots posed the greatest risk of fraud. Jurists, experts, and election officials all concurred that mass mail-in balloting posed the greatest risk of fraud. We just had the biggest absentee-ballot driven election in American history. Yet, the very safety guardrails of this election were systemically and systematically removed, often without the assent or consent of the state legislatures, despite the express promise and explicit protection of the Electors Clause to the Constitution. Midnight counts outside the meaningful observation of poll-watchers. 11% signature mismatches according to the Democratic expert in the election contest in Arizona. Votes from dead people, non-citizens, and non-residents found in the research of Matt Braynard and Richard Baris. Is it really too much to ask that states publish the ballots they promised to publish? Is it really too much to ask that states allow an independently confirmed signature match, at least to a statistically significant sample, of the absentee ballots? Is it really too much to ask for the states to affirm that only those qualified to vote cast ballots for the Presidency?

The Supreme Court directed any remedy to you, and Congress, when it declined to hear the case brought by the state of Texas, a suit joined by the Attorneys General for 18 states representing more than 100 million Americans, 126 members of Congress, high ranking state legislators from the objectionable elections of the states at issue, and public interest advocacy groups representing millions of Americans. I ask that you do me the small favor of simply objecting to electors under the circumstances herein described. At a minimum, it can give confidence to me, and more than 74 million Americans who voted for President Trump, that our concerns about this election were taken seriously and meaningfully addressed in the only place the courts have directed remedy can occur: the halls of Congress.

I just left you a voicemail on this matter. The Majority Statement on Elections which you provided is a cop out in my opinion. I was at the Capitol when I listened to Professor John Eastman tell your peers that even though our Georgia Constitution includes two ways to call a Special Session that under the terms of choosing Federal Electors the Supreme Court has held that the Federal Constitution holds precedence. This statement does not fix the current problem at hand. If you had $100 of real money and saw someone print off $50 from a printer and throw those bills in and tell you that you now have $150 would you just accept that? I do NOT accept the original count or recount even though you have not gone through the legal processes where indictments have been made for fraud. I saw the video where four suitcases of ballots were processed after observers went home. I was there in Cobb County where I saw one bad actor process XX,XXX ballots and then walk out of the counting room out the building with the only hard evidence which backed up the numbers entered into the Arlo auditing system.

I ask for three pieces of information as one of your constituents (even though I vote in Cobb so am not sure my vote even was counted...):

  1. Did you sign the Petition to call for a Special Session?
  2. Did you sign on to the Amicus Briefing today to join Senator Ligon on the TX lawsuit against Georgia?
  3. When you have to vote to send our Electors to Washington DC to have the votes cast - are you going to vote to send Biden Electors, Trump Electors, or No Electors as the TX suit calls for?

I know you represent everyone in your district including democrats, however democrats did not vote for you. Democrats will not vote for you. If you do not protect our right to vote Republicans will vote for someone like Sen. From my recently legal-eze on TDW The Constitution elections clause supercedes the GA Constitution... that they only need simple majority to call Special Session even though GA Constitution says otherwise... and then even if they don't call a special session isn't it their responsibility to nominate electors? So should we not just demand that they don't send electors for our state... or send them in favor of Trump.

  3. We will continue to conduct public hearings up to and through January 5, 2021 to ensure that fraud and misconduct do not taint the next election.
  4. We will fully fund the Secretary of State’s call to investigate out-of-state residents who attempt to move here for the sole purpose of voting in our run-off. We will make sure that these criminals are prosecuted to the fullest extent of the law.
  5. We call upon the Secretary of State to immediately release a certified list of all voters in the November 3, 2020 General Election and a certified list of all newly registered voters in Georgia from October 5-December 7, 2020.

Spread the info far and wide so many people will call legislators. In fact, the court language below suggests that the Speaker of the House and the Presiding Officer of the Senate have the power to convene their respective chambers without any call by the Governor since this is a federal election matter.

The right to vote is fundamental.

The U.S. Supreme Court has held that the right to vote is a “fundamental political right,” “preservative of all rights.” Yick Wo v. Hopkins, 118 U.S. 356, 370, 6 S. Ct. 1064, 30 L. Ed. 220 (1886); see also United States v. Anderson, 481 F.2d 685, 699 (4th Cir. 1973). This right extends not only to “the initial allocation of the franchise,” but also to “the manner of its exercise.” Bush v. Gore, 531 U.S. 98, 104–05, 121 S. Ct. 525, 148 L. Ed. 2d 388 (2000). Infringement of fundamental constitutional freedoms such as the right to vote “for even minimal periods of time, unquestionably constitutes irreparable injury.” Elrod v. Burns, 427 U.S. 347, 373, 96 S. Ct. 2673, 49 L. Ed. 2d 547 (1976); see also Newsom v. Albemarle Cnty. Sch. Bd., 354 F.3d 249, 261 (4th Cir. 2003).

Each House has control of its rules. A majority of either body should be able to convene. A majority of both together can convene. Grab a hotel ballroom if you must, for Covid reasons or otherwise, and act as the Legislature of the State of Georgia under Article I, Section 4. That power is plenary to the State Legislature. John Eastman testified to that fact in the hearings.

This selection from a recent 8th Circuit case (October) interpreting Minnesota's election laws may be helpful to the analysis:

The analysis is relatively straightforward. By its plain terms, the Electors Clause vests the power to determine the manner of selecting electors exclusively in the "Legislature" of each state. U.S. Const. art. II, § 1, cl. 2; McPherson v. Blacker, 146 U.S. 1, 27 (1892) ("The constitution . . . . leaves it to the legislature exclusively[.]"). And this vested authority is not just the typical legislative power exercised pursuant to a state constitution. Rather, when a state legislature enacts statutes governing presidential elections, it operates "by virtue of a direct grant of authority" under the United States Constitution. Bush v. Palm Beach Cnty. Canvassing Bd., 531 U.S. 70, 76 (2000). Consequently, only the Minnesota Legislature, and not the Secretary, has plenary authority to establish the manner of conducting the presidential election in Minnesota.

Senators Introduce Petition to Call Special Session

(December 5, 2020) | Today, Sen. William Ligon (R – Brunswick), Sen. Greg Dolezal (R – Cumming), Sen. Brandon Beach (R – Alpharetta) and Sen. Burt Jones (R – Jackson) have drafted a Petition calling for and convening a Special Session. The petition serves as notification to Governor Brian Kemp and Secretary of State Brad Raffensperger that an emergency exists such that a session of the General Assembly is being called for and convened on Tuesday, December 8, 2020, at 10:00 A.M. in order to attend to such emergency and for all purposes provided for pursuant to Article II, Section 1 of the Constitution of the United States.

This Petition comes after the Senate Judiciary Subcommittee was inundated with affidavits, signed under penalty of perjury, from citizens all over the state who testified to blatant election fraud and many violations of the law that have taken place during the 2020 General Election as well as during the follow-up recounts.

“We recognize our duty to move forward with this Petition due to the level of fraud and violations of law which took place during this 2020 election cycle. We urge others to join us,” stated Sen. Ligon. “We need at least 29 signatures in the Senate on the Petition before 9 AM, Tuesday, December 8, 2020. A similar Petition in the House requires at least 91 signatures by that same time. Now is the time to call your senators and representatives to stand up and be counted on this effort to restore integrity in the election.”

As the Petition makes clear, testimonial and other evidence given before the Georgia Senate Judiciary Subcommittee demonstrated a systemic failure to observe Georgia Election laws. Underage individuals and convicted felons registered and were allowed to vote. People voted who were not listed in the state's records as having been registered to vote. Voters who moved to a different county more than 30 days prior to the election and failed to re-register were allowed to cast votes. Voters registered using bogus addresses such as UPS facilities and other stores, yet their votes counted. Ballots of individuals who were deceased prior to Election Day counted. Over and over again, ballots were counted outside the view of poll watchers or designated monitors, defying the law. Even the law itself was modified by an unconstitutional agreement which weakened signature verification requirements for absentee ballot applications and absentee ballots as set out in Code Sections 21-2-381 and 21-2-386.

According to committee members, that was just a part of the testimony that came before them and much more is still being submitted. Any certification of electors by the Governor of Georgia or the Georgia Secretary of State in light of such systemic failures, the Petition states, would not be in conformity with the Georgia Election Code enacted by the General Assembly pursuant to its plenary power. Therefore, following Supreme Court guidance in Bush v. Gore, 531 U.S. 98 at 104, a state legislature, "after granting the franchise in the special context of Article II, can take back the power to appoint electors.”

“We believe we have reached the point that the results of this election are untrustworthy,” stated Sen. Burt Jones. “Such pervasive disregard for election laws by our election officials requires a decisive response. It is time for our legislative body to do its job.”
