The courts don't care who is doing what to who as long as they do not hurt the child. She could be a saint or a whore, it is all formulaic. The courts look at it as a financial transaction to care for the child so the state does not have to. It would be interesting if the courts would take the new "family" dynamic into consideration when holding adults responsible for financial support, but they still hold on to the notion of mother and father.
The actions by non-legislatures were unconstitutional in 2020 and a law by Congress does not change it. Congress has no power to dictate elections in the sovereign states.
