All of them have hearings scheduled 3 December, a Thursday. Rulings won’t come out on a Friday or weekend, and these judges have no intention of issuing an Injunction to on Monday that would bust the state’s Safe Harbor deadline on Tuesday.
Additionally, the chief relief being asked is decertification. The 23 November SCOMI ruling showed that even judges on our side don’t think decertification is an appropriate remedy. Least of all will it be the appropriate remedy for the last business day before the Safe Harbor. Lower Courts don’t have the balls, or frankly authority, to cost their whole state all of their participation in the election. I understand that we think that is the right thing to do, but these judges don’t.
Come 9 December, the states will file a 12(b)(6) motion against Lin and Syndey and since they won’t have a valid remedy post-Safe Harbor of 8 December, the cases will be dismissed.
