The 1st Amendment does protect "Freedom of the Press", which I'm sure some legal scholars can define much better than I can, but what I think OP is talking about is specifically having a credentialed organization specifically for journalists that gives them certification that can be revoked if they're repeat offenders of spreading mis/disinformation.
If their "Journalist License" is revoked, they will still be able to "publish" articles on the press, but they won't have the "Journalist" certification.
I think part of OP's point is that having these standards set up front will be much more of a proactive way of preventing against the spread of fake news, rather than spending time relying on litigation to solve the issue.
I mostly agree with you on section 230. I'd rather see it go as well.
I think there's merit to looking into this further. Upon a casual glance at it, I'd say there are probably three different "types" of news.
- Classic news - dry facts and reporting of current events
- Editorial news - opinion/interpretation of current events
- Infotainment news - shows that talk about current events but the main purpose is to entertain
OP's idea of having a bar-like entity for journalists is quite intriguing. I like the concept. It'd be interesting to work out how to potentially put this type of structure in place.
