No. The SC doesn’t have to take the case. The people that brought the suit were EXTREMELY smart by a state v state approach.
The SCOTUS can’t make the law fit the crime. What they know or think they know about the election is irrelevant. Fraud within the election is not part of the case.
Texas’ complaint to SCOTUS is that voting laws were changed in a manner that is not directed by the Constitution. Because of this, the SCOTUS should direct these states to do what the constitution says- have the House of Representatives choose the President
