Can you have the felony reduced to a misdemeanor? In my state, California, there are certain offenses, called “wobblers” that can be charged as either a felony or misdemeanor. If charged as the former, upon completion of your felony probation — and if you did not do time in state prison — you can petition for 17(b) PC to have the felony reduced to a misdemeanor. You can also then petition for 1203.4 PC which is expungement. The important part is the 17(b) PC reduction because without it, expunging with 1203.4 doesn’t in itself restore all of your rights, including your gun rights. Perhaps reducing the felony to a misdemeanor is an option because even without expungement, you may have your rights restored depending on other charges you’ve had and other registration requirements (e.g., domestic violence; having been in a mental hospital within a certain period of time). I’m not sure what state you are in or if this is an option depending on the charge(s) but I thought I’d put it out there.
