They should. There are lots of other states just flouting federal laws (recreational marijuana, sanctuary states), they should be able to protect their sovereignty. The problem is, the last time a state tried to enforce immigration laws because the feds weren't doing it, they were sued into submission and just gave up.

I think the point is if they do hear the case, it has to be the DC circuit swamp that takes it, and you can't bring your own case, it has to be joined to any other complaints against HR1, and can only be argued by 1 lawyer who could easily sandbag the case, and then a judge can just dismiss the entire batch with prejudice.
