As far as I'm aware, getting the electors certified is a prerequisite for throwing out Biden's. Now, reps could challenge that, but they hopefully won't win.

Once we certify Republican electors, Pence gets to choose which ones are legitimate on January 6th. Then, Republican just have to hold the line if the Democrats challenge his count.

This might be a bit of a blackpill for everyone, but President Trump has not discounted the possibility that all of our legal cards fail and Biden wins on January 6th. His strategy is not to go around the law in that case, but to become stronger than the fraud in 2024. I don't like it (nobody likes it), but it's the truth.

  1. Legislatures retroactively certify Republican electors

  2. Pence accepts the electors certified by the legislatures.

  3. We win.

Alternatively,

  1. Senators and House reps object to electors

  2. It goes to a vote to accept the electors or reject them (I believe)

  3. Senate deadlocks the vote

  4. Thrown to the House by state delegation

  5. We win

People got so caught up in this complex conspiracy plot that Powell pushed that they set themselves up for disappointment. We're going to go down the legal avenue, and there's no guarantee of success.

A challenge isn't immediately followed up by a House vote. The House and Senate have to vote after the challenge is made on which electors to accept.

I think the vote is to accept electors, not to accept the challenge (could be wrong). If everyone votes long party lines, that would be sufficient to send it to the House.

There are clearly viable paths. Is it a very uphill battle? Yeah, absolutely. But demoralization isn't welcome on this site, especially from an account created expressly for that purpose.

Come to think of it, isn't everything that happens in D.C. a federal issue and therefore under the President's jurisdiction? Could he theoretically pardon everyone in D.C. for all crimes in advance?

Not going to happen, but a fun thought experiment.

They're not liberal, but they're pro-establishment. Federalist Society appointees will be strong on gun rights and religion, but weak in anything that goes against the establishment.
