It's just a way of trying to worm out of ruling on something they know is bunk. You can't sue before damages because no damages. You can't sue after damages because we don't like the implications of how to remedy those damages. Death penalty is expensive af because of all the legal appeals a person is allowed to make to ensure that an innocent person isn't wrongfully executed. You can take whatever stance you want on it in terms of morality or righteousness, but on a purely practical level it's often less expensive to give someone a life sentence.

More pressingly than 230 reform is that companies that handle online transactions (Paypal, patreon, GoFundMe, etc.) will strip any alternative social media sites of funding, try to rob content creators they don't like of income, deny financial support to people in need of backup for reasons they personally disapprove of, etc.
Also of note: There was a high failure rate of mail ballots in a lot of primaries for people not used to voting by mail. So we have a lot more people who are more likely to fall short during normal standards and still saw a lower rejection rate.

It's that it was interpreted over-broadly and there has been no crack down on sites that step outside the bounds of platform into publisher.
