The Plaintiff suffered an injury in fact and actual harm as a result of the unconstitutional absentee ballot processing procedures utilized in connection with the November 3, 2020 presidential election and the manual re-count. The procedures were illegal and in derogation of the state legislature’s clear statutory scheme for elections and accordingly, were unconstitutional. The procedures were promulgated by the Defendants’ in violation of the non-delegation doctrine. Moreover, in issuing these procedures, the Defendants exceeded their statutory authority. These procedures violated the Plaintiff’s constitutional rights to Equal Protection under the law. As a result, this Court should reverse the district court and enter, or direct that the district court enter, an injunction declaring that the election results are defective, and ordering the Defendants to cure their constitutional violations by re- doing the election in a manner consistent with the requirements of the United States Constitution. ARGUMENT
