Seditious Conspiracy found in 18 U.S. Code 2384 which states “if two or more persons...conspire to overthrow, put down or destroy by force the government of the United States or to levy war against them or to oppose by force the authority thereof, or force to prevent, hinder, or delay the execution of any law... or by force to seize, take, or possess any property of the United States.” Rioters clearly committed sedition, they used force to breach the Capital specifically to try to prevent Congress from certifying the election and certifying that Joe Biden is the President of the United States. If that’s not using force to oppose a law of the United States I’m not sure what is.
That takes us to Rebellion and Insurrection which is also covered in 18 U.S. Code 2384, “Whoever incites, sets on foot, assists, or images in any rebellion or insurrection against the authority of the United States or the laws thereof...or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both…and shall be incapable of holding any office under the United States.” this sort of rebellion insurrection we might be splitting hairs they’re not necessarily trying to overthrow the government they’re just trying to change the government which is completely different legally and physically. So agrubley Rebellion and Insurrection doesn’t fit unless a majority of the rioters claimed it was a revolution.
Rioters can also be charged with Advocating Overthrow of the Government. Advocating Overthrow of the Government can also be found in 18 U.S. Code 2384. Some rioters did incredibly stupid things that might toe the line on these for example the right-wing activist Baked Alaska whose real name is Tim Giannay lived streamed himself breaking into the Capital Building and called for all the Congress members to be hung in the middle of the riot. These chargers are totally dependent on how aggressive federal prosecutors want to be and how determined they are to get a conviction.
That takes us to The Anti-Riot Act 18 U.S. Code 2101, The Anti-Riot Act requires that a defendant travel in interstate commerce or use its facilities with the intent to follow one of the objectives listed in one through four with a riot as an objective. This law was used during the trial of the Chicago Seven, in that case seven defendants were charged with traveling to Chicago to start a riot. Count one of the indictment against them claimed they conspired not only in use of facilities of interstate commerce with the intent to incite organize and promote and encourage a riot but, also to participate in and carry on a riot to commit acts of violence and further into the riot and to aid and abet person(s) in such activities. One of the criticisms of this case is that it’s widely regarded as a show trial. People argue this law was used to punish the anti war protesters during Vietnam.
Some lesser crimes the rioters will face are weapons charges, that are found in 40 USC section 5104 which are oddly specific tailored to this specific situation. 40 USC says…”No one may knowingly, with force and violence, enter or remain on the floor of either House of Congress.”
This should be no surprise but, there are laws that say you can’t bring a dangerous firearm on federal property. 18 U.S. Code 930 Possession of firearms and dangerous weapons in Federal facilities.
This should also surprise no one but, there are a bunch of laws that prohibit destruction and trespassing on federal property. FInally rioters can be charged under 18 U.S. Code 351 Congressional, Cabinet, and Supreme Court assassination, Kidnapping, and assualt. “Whoever kills any individual who is a member of Congress or a member-of-congress-elect, a member of the executive bench of the Government shall be punished.” It’s also illegal to attempt to do these things, meaning the guy who brought zip-ties into the Capital will still go down for attempted kidnapping. Meaning even if you went into Congress with the intent to hurt another member of Congress and you looked around and couldn’t find any member of COngress you’re still getting charged under 18 U.S. Code 351.
The last set of chargers Prosecutors can throw at rioters is dependent on how far they want to take it. 18 U.S. Code 2339A Providing material support to terrorists can be used to prosecute the rioters. This was a bunch of people using firearms, explosives, and force trying to undermine the government and achieve political ends in a anti-democratic way to prevent the functioning of the US Government. The bottom line is this was a very serious incident; the rioters can be charged with hundreds of crimes by federal prosecutors.
