Why on earth would they fuck themsleves over? The plan is and, quite literally, always was - to go to the circuit Courts with the inevitable case ending up in the Supreme Court if need be.
The Trump campaign has stated this many times before. The goal is to get the state courts to dismiss the cases brought to them as fast as possible. Very simple to understand.
