I don't think it's as much that, as it is "status quo" -- after the first 10-20 cases got thrown out, they just decided to continue throwing stuff out regardless. Judges are just people and no matter how impartial they claim to be, they are working with biases. If there's 40 lawsuits that have been thrown out, and you're looking at one that is equivocal but goes against what all of your colleagues have said, you're much more likely to throw it out. That is 100% not the right thing to do but they have no accountability on this, they are the final arbiter.
