"A declaratory judgment, also called a declaration, is the legal determination of a court that resolves legal uncertainty for the litigants. It is a form of legally binding preventive adjudication by which a party involved in an actual or possible legal matter can ask a court to conclusively rule on and affirm the rights, duties, or obligations of one or more parties in a civil dispute."-Wikipedia

I'm not involved offline but I can give you the contacts (by email). The atty has previous political experience too. He's run in elections in Maricopa, no less. A very interestingly combined relevant background... You'd probably have a great conversation.

I like the idea of multiple concurrent approaches instead of consecutive efforts. Because we don't know what will work or when. Next week should be interesting with Finchem on Monday and Libertarians on Tuesday/Wednesday.

If it's a crime as Sen. Borrelli states, why not call the police and report the crime?

The AG website says to call the police about an ongoing election crime, and keeping the ballots from the Treasurer is an ongoing crime. It started weeks ago and continues to this day.

If your complaint requires immediate law enforcement intervention due to a crime in progress or an escalating situation, contact your local police department immediately.

The people are complaining to the AZ legislature. The AZ legislature wants to get the AG involved. But the AG says contact the local police.

In theory this is a good idea. But in theory Bill Barr was a going to be a good AG and prosecute the crooks. In theory Mike Pence, Trump's VP, wasn't going to betray him and us. In theory Fox News was Conservative, and would investigate election fraud.

AGs are political animals and do whatever they feel like. Many of them are ambitious and want to become governors. AGs have gone on to become governors. So they make decisions on cases based on, "How will this help or hurt my future in politics?"

Maybe the AZ AG is one of those rare AGs who put country over themselves. Maybe he is like the rare Rudy Guiliani who is tough and takes risks to fight crime.

But what if he doesn't have the constitution? What if he is not based?

If this entire election cycle has taught us one thing it is this: The people you think you can trust can betray you. Find out whom you can really trust. Make no assumptions.

In a state where one party controls all three (Senate, House, etc.) for a long time, there are always left-leaning and right-leaning politicians. (People have to appear R in AZ to get elected.) There are Clean GOP and Dirty GOP.

What is the AG?

Boyer. They need a unanimous R vote. (16 Rs vs. 14 Ds)

Boyer has his own theatrical company.

  1. Say you'll vote with Rs
  2. Co-sponsor bill
  3. Don't warn the Whip you'll vote no
  4. Vote no

The new Bill only precedes but does not exclude another vote-to-arrest vote. (IIUC)

Think of Boyer as Murkowski. The perpetual hold-out b-tch voter. Fake R.

He probably voted yes to the Bill assuming they're be another vote to arrest where he can again vote no.

Jack Dorsey looks and sounds as if he's been cucked by many loud women. He just doesn't realize it. He's a Bubble Boy.

I'll wait until you post more details, but I was just going to note that yesterday the AG published an anti-Ducey document. He put out an amicus brief against the governor's covid decisions. Point being he's not afraid of Ducey like all the other GOP whom you said won't say a critical word about him.

Even so, I must say the AGO can be very political and more political than most people realize. One example is Florida about 15 years ago. There was a huge national scam run out of Orlando. Tons of complaints sent to the AG. Negative press against the scammers left and right. Evidence of fraud far greater than needed to prosecute. Assistant Attorney at AGO ready and wants to file lawsuit. All looks good.

Then the AG transfers the file to Tampa AGO without explanation. The new attorney has a reputation for "making cases go away." He sits on the evidence for months pretending to be serious, waiting for consumer outrage to dissipate. Then he closes the case. Case closed.

The leader of the scam, however, was later arrested, convicted, and went to prison, where he passed away.

The point is, like you realized, an AG can't be trusted because it's an AG. There are corrupt AGs and there are corrupt staff. Just like at the AG under Barr which did useless investigations and never prosecuted.

I have no personal experience with or special knowledge about the AZ AG or any of is staff. Maybe they are different. Maybe they aren't different.

I would never put all or most of my trust in an AG I personally did not know. You can't trust them on timing or final decisions. You don't know their baseline (integrity) before they hear evidence and you don't know how easily they can be bought off after they hear it.

P.S. And, yes, the FL AG in the story was GOP. Labels mean nothing.

Maricopa already disrespected the Judge by being 15 minutes late and the county lawyer speaking nonsense. The atty's argument is they weren't doing an audit, so the LP wasn't invited. Such a dense claim insults the intelligence of the Judge and makes a mockery of the judicial system.

MC has two choices. They have to say there was an audit and they invited the LP and GOP; or they didn't invite them because there wasn't an audit.

The documentary evidence is plain and incontrovertible. MC said multiple times in writing they were doing an audit and in the emails and written statements they admit they didn't invite the LP.

The Judge gave them until the Feb 23rd, 9:30 am.

https://law.justia.com/codes/arizona/2011/title16/section16-624/

The law also says the Attorney General has sweeping powers to enforce election laws.

The Arizona Attorney General’s Office (the “Office”) is authorized under A.R.S. § 16-1021 to enforce certain civil and criminal violations of Arizona’s election code, codified in Title 16 of the Arizona Revised Statutes.

https://www.azag.gov/complaints/election

The AG therefore can seize all the ballots and take them into custody for the treasurer to store in a secure facility.

It's a positive so far but it's not essential. Two other parties have entered the court and both want (and have legal justification to pursue) a forensic audit.

The Libertarian Party filed a lawsuit which can lead to an audit. The LP wants the Republican Party on board. The RP is.

The Legislature is already looking beyond the passing of the new Bill to asking the Attorney General on Monday to conduct a criminal investigation.

If the Judge in the LP case rules the MC supervisors broke the law by not inviting them to their "audit," the BOS is in big trouble.

If the AG starts the criminal investigation the BOS is also obviously in big trouble.

If either of these scenarios unfold, the machines and ballots will be seized and given to the Treasurer immediately as required by law. The Treasurer was required to receive them weeks ago. Once they are in custody, the BOS is basically irrelevant.

The LP, RP, and AZ legislature won't need subpoenas. There will be no further delays to a forensic audit.

There should already be a bench warrant out for the arrest of the person in MC who did not already give everything to the Treasurer.

Snopes fail=snopes failed to do a fact check and bring it to Dorsey's attention.

Perhaps the internal discussion was:

"We need to do a cover-up for Hunter so the big guy is elected... we'll call it hacked and pay the repairman later for his trouble."

America no longer has a real Conservative news network. We are down to blogs and websites.

Trump should build one.
