Rights only have to be read for “custodial interrogation”. So if you are detained (not free to go) The police are supposed to read you your rights before asking you questions.

In a situation like this the police aren’t going to read you your rights (aka the Miranda warning) out in the street. If they want to interview that guy they will do it in an interview room somewhere and most likely have him sign a waiver before talking to him.

Retired cop here. Police unions are part of the problem, not the solution. Agencies without unions drop bad cops in 2 seconds flat. Agencies with unions have to fight, sometimes for months, to get rid of a bad cop. And even then the union usually gets them their job back.
