He won't need to. The DC Circuit Court has 11 Democrat appointees and only 4 Republican. We lucked out with this 3 judge panel having 2 Republican appointees and only 1 Democrat but all it takes is the Democrats to request an en banc rehearing to reverse the decision.
He doesn't need to. Any judge on the court of appeals can request for it to be reheard by the full circuit court. There is already one judge that disagrees with the decision. They will have informal discussions with their colleagues on the bench to see if others share their view. If they believe a majority agrees with them then they will request an en banc hearing.
Sullivan doesn't need to request an en banc hearing. Any judge on the appellate court can request for it to be reheard to the full panel. If that happens expect it to go against Flynn because there is zero chance they would request an en banc hearing if they didn't know they would already win it prior.
