If that were to be the case they would have to be within the "safe harbor" period for appointing electors set out by congress. I want to say this is about 2 days before the electors' meetings at their state capitals. That would give enough time to step in via either the courts or an appeal to the state legislature.

Remember, the certification of a popular vote is handled by a state's executive branch (SoS overseen by the Gov.) but the final certification and appointing of electors is handled by the legislative branch as per the constitution. Thus, if there is significant chicanery by the executive branch, as in the case of waiting until the last minute, that would leave Trump's team the chance to present their evidence directly to the legislature(s) evidencing fraud. Then, if even a modicum of sanity prevailed, they would appoint Trump's slate of electors. It might be a while, well into 2021, before we got a final tally on the real vote totals, but Trump would be sworn in in Jan.

Maybe I'm too forgiving. I'm willing to give him a chance to turn state's evidence and point fingers and name names on this whole vote stealing cabal. In return, we put him in a nice nursing home which we decorate like the oval office and tell him he's president for the rest of his life. Maybe send in some mannequins with wigs on every so often to give him a few courtesy sniffs.

You can't (CANNOT) pull off fraud of this magnitude without leaving massive evidence. DJT is President, meaning he has access to all the intel he could ever want about this kind of chicanery. I think the lawsuits are just priming the pump for the real evidence coming soon.

Nah, this is just the set-up for the court challenge. You mix in too many obvious fraud votes and it taints the whole pool. This triggers the "equal protections" etc. clauses whereby the federal cts get to nuke the whole thing. GA legislature (repubs) get to name their own slate of electors.

This needs more attention. Here is the key quote:

"The good news is that the Trump team only needs to prove these claims by a preponderance of the evidence rather than beyond all reasonable doubt, which makes it a much easier nut to crack."

As a point of law, this means it will be much easier to throw out the fishy ballots. Meaning, team Biden has to prove that the pallets of midnight votes are good, rather than Trump having to prove they are bad.
