Its a little more complicated than that. If you read the law, there are three different categories of votes:
- ‘regular’ single slate electors
- ‘Regular’ dual slate electors
- Dual slate electors that are non-regular
I believe both house and senate need to agree to throw out category 1 and two. But they need to agree to keep 3
What makes a stale of electors non-regular I dont know, but I’m guess questions of fraud, or a pending Supreme Court case would be one of them.
