There likely will be more than one case. If we get ruled against by SCOTUS its possible that the Congress can refuse to seat the electors and take the vote themselves. However, a favorable SCOTUS ruling greatly increases the chances of that, as it gives them quite a bit of political cover to do so.
I’m pretty confident SCOTUS will rule in our favor in PA as they clearly violated the constitution instituting mail in voting without consent of the legislature. A favorable ruling in PA will break the dam in the other state. Be prepared for an exciting week ahead!
So tommorow is ‘safe harbor’. Constitutionally it doesn’t mean anything, but statutorily it means that if there is a contested election, the electors cant be legally seated until the dispute is resolved.
May end up in Supreme Court or may end up that the electors, while not going to Trump, cant be awarded to Biden, and increases the possibility that the House makes the vote
