Everyone that's on twitter calling for republicans to be "put on lists" after AOC's tweet should themselves be complied onto a list of their own. It's absolutely amazing how he does this, and also how you KNOW he MEANS WHAT HE SAYS, and has passion behind his words!
i always challenged my public speaking Teacher in HS by saying things like "why do I need to write a speech out?" and "if I really mean what I'm talking about, I shouldn't need que cards" or something prewritten out at the stand.
For the 'final' where we had to give a speech before the class I turned in empty 3x5 cards to prove my point. Teach passed me reluctantly.
Not sure where this would go, but I need help/suggestions. Also, this is going to be very region specific, and there is a "Preface", "Meat and Potatoes", and a "TLDR" section for those that want to skip a bunch of stuff.
I’m at a serious turning point involving a business openly discriminating against me/violating HIPPA and need help on what to do, and what my next steps should be.
These incidents pertain to 3 specific locations in Michigan, but will be focusing primarily on the most egregious offender: Subway.
I’ll try to stick to the specifics, as this will be very “long winded” and giving as many details as I deem fit without it being completely prying into my personal life. I will also be posting this across a couple different groups or pages. Sorry if you see it thinking it’s a duplicate post.
PREFACE: I’m a partially disabled (difficulty walking from injury), and currently on disability leave from work. I do not wear a mask when, on the rare occasion I do go outside my home in the last 8 months, as my injury has basically left me home bound (since End of December 2019) and only recently have been re-learning/teaching myself how to walk again.
I claim medical exemption due to the 60+ lbs I’ve put on (in the last 6-7 months) as a result from the injury (going from a very active lifestyle to completely sedentary within 24 hours) as well as depression and a bunch of other things that 2020 has brought/forced upon me. On top of that I’m prone to bronchitis, and have an upcoming surgery I’m trying not to jeopardize/push back (yes I understand the irony with not “wearing a mask” but that’s a different discussion, so we’ll table that.)
Needless to say, it has been an extremely trying year, both physically, mentally and emotionally.
I find it very difficult (as I’ve been increasing activity from such a long stretch of inactivity), especially on hot/humid days, to breath through a “plastic” disposable mask, (which even surgical masks are proven at 62% effectiveness against COVID-19’s molecular structure) and find people wearing shirts/scarfs/other face coverings that do not have filters or not completely covering their mouth/nose to be a stupid and completely useless concept in all ways except that it somewhat shields me from that person exhales/produces, minimal as it may be.
“Meat and Potatoes”: On 7/29 I visited the Subway on the corner of Lake Michigan Drive and Wilson to pick up an order I placed online. When I walked in to the establishment, I stood close to the door, and when the people behind the counter looked up at me I said “I’m here to get my pickup order”. I was immediately told by the the shift manager that I need to put a mask on. I told her that “I have a medical condition, can I get my pickup?” She the proceeded to tell me “I don’t care, you need to put on a mask. It’s the law”. The next 3-5 minutes then proceeded a back and forth between me and the shift manager, me trying to explain that she just violated HIPPA, and she can’t just say “I don’t care” to someone telling you they have a medical condition.
This was what I consider “the straw that broke the camel’s back” after having a similar, yet less confrontational incident at the Meijers near the same intersection. I had just gotten done talking with my father a couple nights before (who deals with HR, HIPPA compliance, etc.) about that situation and he told me what they did was wrong, and they can’t discriminate or attempt to deny service based on that situation.
The entire time I was being instructed to get outside, or to put on a mask and was being actively denied service at that establishment by that employee, multiple times. I also tried educating the employee saying that the “executive order was not law” and the employee consistently implied it was ‘a law and I need to go outside or put on a mask’. I eventually did get my order after verbally fighting the company and telling them they’re “trying to deny me service on goods that were already paid for” and after the 3rd-4th time, she finally gave in and gave me my order. Had she done what she was supposed to and ask me to put a face covering on, and then move past it when I told her I have a medical condition, I wouldn’t be writing this, and would have been in and out in less than 30 seconds.
I feel like I was openly denied service, based on a “law” that is not a law, and openly discriminated against as a disabled person with a medical condition. To me, this is an ADA violation, a HIPPA violation, discrimination/harassment, and violation of Title 18 Section 242, and a denial of my civil liberties.
I’ve tried over the last 2 weeks to contact the manager/owner of the Subway, and only today (8/11/20) got in touch with the Store manager, to which I had a 40 minute conversation to which I feel like I was given the same rhetoric of “I’m sorry you feel that way, this is how we’ve been handling it” and not really acknowledging the employee’s wrongful and honestly illegal actions. I did file a complaint on the website and basically got the same “non response” to which I will cite the last line of:
“Our employees are required to follow all the directions of the Governor's executive order and the rules as outlined by the Kent County Health Department”
To me, this seems like they’re standing behind their employee’s actions and plan to do nothing about it. I feel entirely helpless and been wronged/openly discriminated against. They don’t seem to take this seriously, and have done NOTHING to reach out to me, or even offer to refund my order for my troubles. I’ve asked the Owner David to reach out to me, but based on his email, I don’t plan to get anywhere with him via civil discourse. So far, “outreach” has been solely on me, as I’ve left several messages for the Store Manger to get ahold of me, to which they made no effort to call me in any fashion, so far as I know.
TLDR: I feel I was actively denied service on paid for goods, they clearly and openly violated HIPPA, possibly the ADA, title 18 section 242, and they just don’t give a shit, and plan to do nothing about it.
What are my options, and what should I do from here?
