Teacher here, this is within schools rights to do sadly. The school system is responsible for following public health guidelines and those are deemed by local ordinance. Operating procedures for schools are typically done on a district level, which is often full of beau acratic bullcrap sadly.

I don't know if there is a US constitutional provision that would allow a Law to be made permanent. The system is designed to change over time, and creating permanent laws is something I think the founding fathers knew would be an incredibly dangerous slippery slope.
It isn't about being nice, it is about being legal. Threatening the life of a sitting justice is not a fun conversation to have with the alphabet groups. This isn't dooming, I dont believe we should be threatening the life of anyone.
