The government doesn’t normally need to present witness testimony as part of a detention hearing because as officers of the court, and as official representatives of the Executive Branch, the prosecutors have legal and ethical obligations to not mislead the court about the nature of the evidence.

There were no "competing envelopes". Every state certified and transmitted only one slate of electors.
Again, there is no basis in either the Constitution or in the Electoral Count Act for Pence to do any of these things you mentioned:
he could pick which to accept and reject any State for fraud.
Pence to have directed the meeting to look at evidence of fraud, which was ALREADY SCHEDULED!
He couldve kept that meeting in session through 1/19 and it would have been no crisis.
This is all made-up nonsense. The Electoral Count Act is the law that names the Vice-President as the "presiding officer" of the Joint Session where the electoral votes are counted. That means he holds the gavel and conducts the meeting according to the specific rules set out in that very same law. It doesn't magically grant him the power to do whatever he wants. There is a specific and detailed process for submitting objections to electors and the VP has nothing to do with it, except to make sure the process is followed. There is a specific and detailed process for adjourning the proceedings and the VP has nothing to do with it, except to make sure the process is followed and to cast the tie-breaker vote if that adjournment motion was being considered by the Senate and it was tied 50-50.
Read the law yourself, if you doubt me.
It is the highest law in the land. These are the only words in the Constitution about the VP and the electoral count:
the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted
That's it. He is to "open all the certificates" and then "the votes shall then be counted". Where does it give him the power to decide certificates are to be rejected? Where does it say he can "send them back to the states"? Where does it say he can blow the whistle and delay the count for ten days?
Yes, the election was stolen. The courts needed to act and didn't. Since they didn't it was up to the state legislatures to act. They should have passed resolutions decertifying the Biden electors and naming Trump electors in their place. They didn't.
VP has no power to do anything about it.

The VP's limitations are in black and white in the Electoral Count Act. Eastman's theory was a legally baseless fantasy.
Literal foreign invaders carrying the banner of our current "President". Meanwhile, the DOJ is cooking up thousands of years of jail time for patriotic Americans who wandered into the Capitol and took some photos. While remaining within the rope lines.
Pence is no traitor. He did not have the power to delay the proceedings of the 1/6 Joint Session or "send electors back to the states" or anything else that could have stopped the steal. John Eastman gave President Trump bad information and extremely bad advice in that regard.
EDIT: And not one of the downvoters can cite the law that would have allowed the fantasy scenario to happen. Because it doesn't exist.
Read her proposed changes to the law. They gut its central purpose.
She completely removes prohibitions on trans in college women's sports and allows trans in k-12 by defining "biological sex" as what is on the student athlete's birth certificate or "affidavit provided upon initial enrollment".
In other words, under Noem’s proposed changes, a biological male would easily be able to participate in women’s sports in South Dakota (even in K-12) as long as he files the proper paperwork.

It also needs to fix voting and clarify that birthright citizenship does not apply to those born to people either unlawfully present in the United States or lawfully present through temporary authorization (tourist visa, student visa, etc.)
Nah, it's Trump for me. But this movement is fucked if the "Pence is a traitor" retards really represent anything more than a sad micro-minority.
Not one of you can cite black letter law that gives the Vice President the authority to do anything meaningful in the Jan 6th Joint Session. Because it doesn't exist.
That's it right there. Pence never had any power to do anything about it. The states needed to decertify and name Trump electors instead. That was the only chance.
4 1/2 months later, we're still waiting for the "audits" that were promised by those same legislatures.
This is not the way.
