As a hypothetical for any reason is fucking crazy. How about to rightly point out that per our founding documents we have a duty to rightly take up arms against any government, including Joe Biden if the create a system of violating the constitution. There is no fucking way thats a crime. To call that a crime supposes some sort of legitimate way for the constitution to be violated.
